Federal Court in Kansas Applies Del. Cases to Advancement Statute

In Westar Energy Inc. v. Lake, 2007 WL 1856927 (D.Kans., June 28, 2007), the U.S. District Court for the District of Kansas interpreted the Delaware advancement statute, Section 145(e) of the Delaware General Corporation Law (DGCL), and the Delaware cases that interpret it, and predicted that its decision to reduce by 50 percent the amount requested for advancement of fees would be the same result reached by a Delaware court presented with the same issue.    More
