The Delaware Superior Court has granted the Department of Justice’s motion to allow the use of hypergeometric sampling to determine whether a large quantity of a substance is illegal drugs.

Resident Judge T. Henley Graves ruled in State v. Roundtree, a case out of Sussex County, that the Department of Justice could apply statistical analysis to determine the nature of a large haul of seized substances suspected to be illegal drugs. He made the ruling from the bench Sept. 14 and issued a letter opinion three days later to explain his decision.
