In a year that has seen a record number of judicial vacancies in Delaware, two members of the commission charged with filling those positions have resigned to pursue judicial vacancies.
The practice, which is not new in Delaware, has been criticized as creating a negative perception: that those responsible for selecting judges are applying for openings created by the commission’s choices. But others say it’s irrelevant because the governor, not the commission, has the final say on judicial candidates.
