A man convicted of driving under the influence was denied a new trial after the Superior Court last month determined a witness’ statement regarding his prior DUI conviction did not sufficiently prejudice the jury that ruled against him.

The ruling, set out in a 14-page order by Judge Paul R. Wallace, came on the heels of a criminal appeal of a Court of Common Pleas decision not to grant a mistrial in the case of Ioannis Alexopoulos, who was arrested on suspicion of DUI and two lesser charges after crashing his truck into a guardrail outside of Wilmington in May 2014.
