Federal courts may amend execution orders based on new facts or evidence, the U.S. Court of Appeals for the Third Circuit has ruled. The appellate court’s decision affirmed a U.S. District Court for the District of Delaware opinion invalidating an execution order after a defendant eventually paid off the judgment awarded during a trial.
Ocean City Costa Rica Investment Group LLC, a Delaware limited liability company, filed a lawsuit against Camaronal Development Group LLC, a Brigantine, N.J., financial company, alleging that the defendant did not return the plaintiff’s deposit on a failed real estate transaction. The parties resolved their dispute, Ocean City Costa Rica Investment Group LLC v. Camaronal Development Group LLC, through mediation and Ocean City was awarded judgment in the amount of $275,000, according to court documents. Ocean City’s award was affirmed by the District of Delaware and the case was believed closed.
