In a case where an expert report is not required, the court may insist that a plaintiff provide disclosures that explain expert witnesses’ specific opinions and the bases for those conclusions, a Superior Court judge in Kent County has ruled.

Judge Robert B. Young wrote in a July 30 opinion that expert reports would be “optimal” in personal injury case Dixon v. Batson, but a collection of nearly identical descriptions of expert opinions by the plaintiffs’ counsel would not satisfy Superior Court rules. Young said the plaintiffs must supplement the existing reports that he said were inadequate and provide curricula vitae for each expert.
