With Delaware’s death-penalty statute no longer on the books and first-degree murder cases set to resume, another legal battle over the fate of the 13 inmates 
currently on death row is expected to play out in the coming months.

Superior Court Judge Jan R. Jurden on Aug. 18 lifted a temporary stay of all pending trials and penalty hearings for those accused of the state’s most serious murder charge, just over two weeks after the Delaware Supreme Court struck down the First State’s capital sentencing scheme as unconstitutional.
