The Delaware Supreme Court has affirmed the dismissal of a Lewes man’s challenge to the construction of a windmill near his home, ending a nearly four-year “crusade” over the state’s use of land once set aside to build an industrial park.

In 2012, Gerald Lechliter, a retired Army colonel, sued the Department of Natural Resources and Environmental Control and a number of other defendants involved in the transfer of land and construction of the windmill. Lechliter claimed the windmill, located about a half-mile from his home, caused him personal injury and property damage from the noise it emitted, a flashing red light on the turbine and the windmill’s interference with his enjoyment of his property.
