In a court filing, the acting warden of James T. Vaughn Correctional Center on Wednesday called a prisoner lawsuit stemming from the Feb. 1 takeover at the Smyrna prison a “broad and vague” attempt to usurp the state’s ongoing investigations into the ordeal, which left a corrections officer dead.

Warden Phil Parker, through an attorney for the Delaware Department of Justice, said prisoner Donald Parkell had not shown he was likely to succeed on the merits of his case, filed less than two weeks after a group of inmates seized control of JTVCC’s Building C for more than 18 hours.
