The Court of Chancery has tossed a constitutional challenge to a Delaware statute that denies inmates access to Department of Correction policies and procedures for failing to establish standing, saying the plaintiffs’ position would undermine public policy and jeopardize safety.
The two pro se plaintiffs—one a current prisoner at James T. Vaughn Correctional Center and the other a former inmate—argued the statute violated two provisions of the Delaware Constitution that work to ensure transparency on the part of government agencies.
