A former Goldman Sachs & Co. computer programmer, who for years has been seeking in New Jersey courts the company’s indemnification for legal defense costs, now finds himself in a battle over which Delaware court, if any, could hear his plea for advancement of fees in litigation against Goldman Sachs.

Sergey Aleynikov filed a complaint in the Delaware Court of Chancery earlier this month in an effort to compel Goldman Sachs to advance his legal fees solely to defend the counterclaims Goldman Sachs filed against Aleynikov in his earlier New Jersey suit seeking advancement of fees for his criminal prosecutions and appeal.
