A single judge of the state Superior Court does not have jurisdiction to review the actions of two Superior Court judges acting as a Board of Canvass following an election, the Delaware Supreme Court has ruled.

The court on May 14 vacated a holding by a single Superior Court judge, which had said a Board of Canvass acted improperly during a recount of the November 2014 general election for the Office of the Recorder of Deeds for Kent County. The Supreme Court made final a certified result from the Board of Canvass, which had declared Betty Lou McKenna as the winner.
