Marathon Petroleum Corp. and Speedway LLC tried to keep alive a federal lawsuit last week that challenges Delaware’s controversial unclaimed property collection scheme.
An attorney for the oil giant and its subsidiary told U.S. District Chief Judge Leonard Stark of the District of Delaware that the state has been on a nine-year “fishing expedition” into company records, and that its latest requests for information are pre-empted by federal common law.
