The Delaware Superior Court has allowed a police officer’s widow to pursue civil conspiracy and implied warranty claims against a company that manufactured and sold the bath salts a man ingested before stabbing the officer to death.

David Salasky bought the bath salts, a since-banned synthetic drug known to mimic the effects of cocaine, methamphetamine and LSD, from the American Cigarette Outlet in New Castle County in September 2011. A day later, after consuming the drugs, Salasky stabbed New Castle County Police Officer Joseph Szczerba multiple times, as he responded to a 911 call.
