In the year since Delaware launched a revamped arbitration initiative allowing parties to settle disputes quickly and discreetly, the program has so far failed to gain traction among litigants, as not a single proceeding has yet been filed under the new system.

The Delaware Rapid Arbitration Act, which went into effect May 4, 2015, was touted as an “additional option” for business entities seeking to resolve disputes in a “prompt, cost-effective, and efficient manner.” However, as of last week, no litigants had availed themselves of the new system, a court official confirmed.
